Book Description

After working hard to build your nest egg, you are finally making plans for your retirement years. But will you be free to make your own choices when those golden years finally arrive? Or will you fall victim to ruinously expensive involuntary conservatorship/guardianship proceedings and be stripped of your rights, your money, your independence -- for the rest of your life?

In an onimous trend that threatens America's successfully aging population, state judges are imposing an increasing number of unwanted conservators and guardians upon allegedly incompetent men and women to manage their property and personal affairs. The results are grim. In New York alone, judges appointed over 32,000 guardianships during 1997, up from 15,000 in 1992, and Michigan's guardianship petitions have more than quadrupled since 1981.

These little-known state laws were originally created to safeguard the rights of "infants and lunatics." Today, involuntary conservatorship and guardianship laws are being used by calculating heirs to seize control of their parents' assets and by protectors in the social welfare community to control the vulnerable elderly themselves. And who is "elderly"? To be declared incompetent on the basis of age you only have to be 62.

Drawing on sadly typical cases from courtrooms across America, Dr. Armstrong shows how competent elders can be victimized by arbitrary conservatorships and guardianships. She describes the historical roots of our codes and shows how they function in today's courts, highlighting concepts that are problematic and suggesting appropriate changes. Dr. Armstrong summarizes every state's conservatorship/guardianship statutes and provides contact numbers for national services, legal organizations, state offices of aging, and other resources for the elderly. Most importantly, her breakthrough book gives YOU the tools you will need to protect yourself or someone you love when your retirement years usher in the real threat of predatory litigation.

5 out of 5 stars Finally the real truth about this national disgrace!.......2004-08-27

This is a must read book about the truth of the rampant fraud and abuse of conservators and guardians. While this author writes about family members trying to get "Granny's dough", she does touch on another perverse type of guardian, that is a "court appointed" guardian. In Florida, and in many other states, they only require a high school education and a 40 hour course. But whether educated or not, from the lawyers/guardians in the recent New York case, to the high-school educated sociopaths here in Pinellas County, Florida, they are getting away with fraud and abuse.
To avoid a guardianship in the State of Florida should be of paramount importance. Find out how to protect yourself and your loved ones with alternatives: health care surrogate, durable power of attorney, mediation and more. Consider that if you leave your parents to fend for themselves, and ignore the deterioration associated with aging, a guardian can gain a guardianship over them and their assets, without informing you. That guardianship will nullify the most meticulous of plans. To really cover your aging parents, make sure they create a "Pre-need" guardianship and name someone they trust, this is the only way predators in the retirement homes will not be able to force guardianship on them. Also create an irrevocable trust.

5 out of 5 stars An uncoventional but effective planning guide........2000-08-03

Retirement Nightmare isn't your typical retirement guide on how to save up enough money or make investments: its focus is on how to protect yourself from heirs, and chapters survey involuntary conservatorship and guardianships with an eye to revealing how incapacitated seniors fall victim to the statutes designed to help them in their old age. Advance planning is recommended as the key to avoiding situations such as the author's own experience and those described in courtroom cases.

5 out of 5 stars Thankful for this work.......2000-06-21

Dr. Armstrong has produced a document vital to the safeguarding of personal dignity in today's world. In language accessible by anyone reading the book, she dissects complex legal matters and lays them out in plain view for all to understand. This book should be required reading for all people tasked with ensuring our personal rights within the framework of our various legal systems. It should also be recommended reading for anyone when the natural course of life puts them in a position of reliance on the ethics and goodwill of others...even those 'nearest and dearest' to them. When we are vulnerable... that's when we need help. This book gives us the ammunition to help ourselves. Everyone intends to survive the journey to the retirement years; this book exposes some of the ambushes that others have found there and lays out steps each of us should take to avoid those ambushes. As proof that fact can be scarier than fiction, this book will curl your hair quicker than anything King has ever put on paper.

5 out of 5 stars An Invaluable Source.......2000-06-19

As a lawyer, I found this book to be a tour de force compendium of the guardian and conservatorship laws in our country. For both lay readers and lawyers, it is an invaluable reference tool - comprehensive and clearly written. Full of actual stories of actual individuals, it also makes for eye-opening human interest drama.

5 out of 5 stars Be Informed...Be Prepared!.......2000-06-16

If you are elderly, or even think you may someday become so... then...you need to read this book and keep it close at hand as one of your most valuable reference sources. Dr Armstrong draws on her tragic family experiences with involuntary guardianship litigation and combines that with excellent and scholarly research, to produce a book containing historical background, the law, a broad range of case studies covering most aspects of the subject, and many answers/recommendations concerning this potential problem that we might all someday face. The appendices covering the various state laws and hundreds of resources for the elderly, are alone worth the cost of admission! I found the book to be alarmingly informative and I feel much more knowledgeable and secure now that it is sitting on my research shelf.

    Book Description

    In Sub-Sahara Africa, the sector of informal micro-enterprises (IMEs) is already employing a large share of the labour force in both urban and rural areas. This study reviews the ways in which the owners and workers of IMEs have acquired their vocational and management skills. It reviews the contributions of all the different training providers, including public sector training institutes, private sector training providers, and training centres run by NGOs and other non-profit organizations. The study finds that informal apprenticeship training is by far the most common source of various skills - in some countries it is likely to be responsible for 80-90% of all ongoing training efforts. Informal apprenticeship training presents a number of important advantages. At the same time it has a number of limitations. The study concludes that there is a major challenge to improve the transfer of relevant skills to IME operators, both through pre-employment training and skills upgrading. In view of the scope of the challenge to provide hundreds of thousands IME owners and workers, as well as large numbers of out of school youths with relevant practical and management skills, it suggests to build upon the strengths of the existing practices of informal apprenticeship training and to remedy its weaknesses by involving professional training providers in upgrading its training organization and delivery, quality and efficiency, and final training outcomes. It reviews the results of a number of innovative interventions in different African countries that are working in this direction. Finally, the study suggests that there is an interesting potential in ‘business-embedded training’ provided by private companies as part of their regular business operations.

      Reviewed Kathleen Dowdell for Reader Views (2/07)

      "How to Enjoy Your Retirement" is a provocative, well-written book about activities you can do to help you enjoy your retirement. This third edition, published in 2006, keeps pace with constantly changing information that is available at our fingertips. In the introduction, the authors advise taking a personal inventory of what you think you will need or desire in your retirement years. Appendix A contains questions such as: Who Are You?, What Do You Do Well?, Why Are You Retiring?, and How Do You Feel About Retirement? This is a useful tool to evaluate your situation since your life will be dramatically changed with an abundance of free time on your hands (unless you plan on babysitting for the grandchildren). If you do decide to spend lots of time with your grandchildren, Appendix B lists numerous activities that you can do with them. Appendices C through I are broken down into additional resources, activities, tips and suggestions that will aid in the transition into retirement. An appendix dedicated strictly to travel provides names, addresses, and phone numbers of airlines, car rental agencies, cruise lines, hotels, vacation homes, and state visitor bureaus as well as internet sites related to travel. There is a wealth of information in these sections alone.

      The meat of the book is found in the list of activities alphabetically listed from A through Z which offers a wide variety of ways to spend free time in retirement. There are over 1000 ideas sure to spark the creative side of any brain. Topics such as Chatty Cathy - "get your Chatty Cathy doll fixed by e-mailing Chatty Cathy's Haven" and Seasonal Contests - "start seasonal contests for guessing when the first measurable snowfall will occur" or this is your life - "make a video for yourself or someone else" are sure to motivate anyone to action for activities and further research.

      This is a fun, quirky book that can be used for the serious undertaking of searching for activities to do during retirement or as a book of light reading to pass the time. The book can be used as a resource to brighten your mood on a dreary day or to find further information on the web for a topic you wish to pursue. Authors Tricia Wagner and Barbara Day compiled the A to Z activities from ideas and experiences of friends, family, neighbors as well as themselves because they saw how individuals' perceptions of retirement have changed over the years. They felt a need to address the variety of feelings people approaching retirement experience and to share information to help with these ambivalent feelings. Their success is apparent in this 3rd edition. "How to Enjoy Your Retirement" book would make a nice gift for someone approaching retirement or for someone who has been retired for a few years and wants to add some excitement to life by pursuing new avenues and areas of activities.

              Book Description

              The purpose of this article is topresent rules and regulations in effect as of this writing for making distributions from qualified retirement plans and IRAs in a concixe, organized and coherant format which may serve as a reference resource to all persons concerned with this subject. Be aware that Congress and the IRS have tinkered with these rules for the past twenty-five or more years and will in all likelihood continue to do so.

              The presentation is mad in three parts: Part 1: contains anoverview of distribution taxation and details the rules pertaining to required mimimum distributions. Key elements of th Tax Payer Relief Act of 1997 affecting retirement and estate planning are presented;

              Part 2: reviews the issues involved in preserving qualified plan and IRA funds in estate planning situations. Planning considerations are also presented;

              Part 3: consists of case studies illustrating the results from various distribution options;ie, "running the numbers."

              Customer Reviews:

              4 out of 5 stars A Good Reference for a Difficult Subject.......2000-07-06

              As the previous review suggests, this book is not an easy read. Unfortunately, this is not the author's fault! The rules governing the distribution of retirement plan assets are extremely complex--and purposely so! The more complicated they are, the more likely the "average" joe will make a mistake and have to pay the Government more. But, it is an excellent resource for people trying to make sense of this complex subject. If you are a CPA or other advisor (like me!) trying to help a client, this is an excellent "library" book. If you are John Q. Public, looking for a place to start, this one might be a tough read, but will be well worth the effort.

              1 out of 5 stars Accurate but technical.......2000-03-17

              This book is constructed in a way that is very similar to IRS and tax law documents. It does contain accurate and specific information about IRAs, but is not user-friendly. It is difficult to understand (not written for a lay-person) and constructed in an outline type format that is difficult to manuever. If you are looking for a book to help you with IRA withdrawal information, this one is not it.
