Most of us know that upon our demise, a succession of fees and taxes will eat into our estates--no matter their size--if we don't plan now to protect them. Unfortunately, many of us still postpone this process because we hesitate to summon the outside legal assistance that's traditionally been required. The folks at Nolo Press have made it their mission to provide us with the means to complete a relatively uncomplicated official arrangement like this without lawyers, however, and their third edition of Make Your Own Living Trust offers hope even to the most hesitant among us. With easy-to-follow instructions, helpful worksheets, and all of the forms necessary, attorney Denis Clifford shows both individuals and couples how to avoid otherwise inevitable delays and costs by preparing on their own to transfer their property directly to their designated heirs. Clifford's method involves the creation of a "living trust," which is a basic legal entity that allows property to be simply passed along in this way immediately upon the death of the person who created it. He outlines advantages and drawbacks, and then clearly lays out the entire process. The excuses stop here. --Howard Rothman

Book Description

No other book covers living trusts better -- or more simply -- than this bestselling book.

Death may be inevitable, but probate doesn't have to be. By creating a living trust, your property will bypass lengthy and expensive probate proceedings and go directly to the people you've designated, quickly and easily.

Make Your Own Living Trust explains how to create a living trust, transfer property to the trust and amend or revoke the trust at any time. Specifically, it covers how to:

*create various living trusts, including an AB trust (also known as a "marital trust" or "bypass trust") *transfer assets to your trust, including real estate, stocks and bonds, jewelry, art or a small business *name beneficiaries for all trust property *sign your document and make it legal *appoint someone to manage property left to minors or young adults *provide for trust property management if you become incapacitated *retain absolute control over trust property while you live

Make Your Own Living Trust includes all the forms you need -- as tear-outs and on CD-ROM -- to create your own trust, plus step-by-step instructions for filling them out.

Completely updated and revised, the 7th edition covers the "disclaimer trust," an excellent option if you're not sure whether you need an AB trust. It also provides new information on the rise of state estate taxes.

Good in all states except Louisiana.

5 out of 5 stars Best resource on the subject.......2007-08-16

In order to help my parents with their trust, I had checked out about a dozen books on the subject from the library. I found Denis Clifford's to be the easiest to follow and easiest to read on a fairly complex subject. I found the book (and his "Plan Your Estate" book) so informative I bought a set for myself.

This book offers lots of "real life" examples of different types of financial scenarios and the best options for setting up a trust that will protect the assets from excessive legal fees and/or estate taxes. It covers almost everything you need to know to either write your own trust or carefully check the details of your trust if prepared by a lawyer.

The CD included provides you with the language you need to write your own by filling in the blanks, as well as the step-by-step procedure to cover all the bases to be certain the trust meets all the legal & tax requirements for trusts.

This book is also apparently updated each year, as the tax and estate laws are frequently being revised. I highly recommend this book, and also highly recommend as a companion book that covers other aspects of financial planning, wills, etc., Dennis Clifford's Plan Your Estate.

I was so impressed I also bought copies of both books for my parents and my sister so we could all get our finances in order.

Nolo Press continues the tradition of providing step by step guidance through complex legal processes. Step by step demystification of the process.

Even if you are going to use an attorney this is a good read and you will save many times the cost of the book in having answered your own questions and by receiving a good introduction to the subject.

Highly recommended

I am an attorney (shyreslaw.com) and I highly recommend this book for those who could use a simple trust and want to avoid probate. Even if you decide to hire an attorney, this book is invaluable because it offers great insight into trusts and avoiding the probate system.

Attorney Denis Clifford wrote this great do-it-yourself book which provides everyone a way to create their own simple living trust. A CD-ROM is also provided so you can easily input your information and print it out.

For a more complete estate plan, the book introduces the importance of pourover wills in case the trust fails to encompass all the property. You may want to peruse Mr. Clifford's Simple Will Book as well (another recommended buy).

"Make Your Own Living Trust" was so easy to follow I recommend it to all the baby boomers. The disc attached to the back made it easy to print the required forms.

5 out of 5 stars Great buy!.......2004-05-18

This book was a god-send! I was skeptical at first because I have no legal backround and I thought that making my own living trust would be complicated at best, impossible at worst. But following a recommendation of a friend I decided to give do-it-yourself law a shot. Boy am I happy I did! I saved a fortune in legal fees and was able to get the job done just as well as if I'd had a lawyer coaching me every step of the way.
Make Your Own Living Trust was easy to use and very accessible. It even has all of the forms you'll need on an enclosed CD-ROM. Thanks to this book I was able to transfer assets such as stocks, real estate and jewelry to my trust, appoint someone to manage the property that I'm leaving my children, and keep control over it while I live. So don't be afraid to do it yourself, you'll save money and get your trust done the way you want it!

IRA's, 401(k)s & Other Retirement Plans, by financial specialists Twila Slesnick and John C. Suttle, is a solid self-help legal look at a critical back-end issue that most of us blissfully ignore until we absolutely must confront it. The authors themselves admit it is not a compelling page-turner, but rather a comprehensive resource that at some point should prove indispensable to everyone with a retirement plan. They describe the various plans available--including Roth IRAs, to which an entire chapter is devoted--focusing on distribution rules, associated taxes, and potential penalties. They offer details on early distributions used to pay higher-education expenses or health-insurance premiums (which are not subject to taxes, under certain explicit conditions), distributions you must take during your lifetime (when they begin, how they're computed, what happens if your beneficiary changes), and distributions made after an account holder dies (largely concentrating on administrative procedures that could help you avoid unnecessary financial loss). Helpful appendices include relevant IRS forms, notices, and schedules as well as life-expectancy tables. --Howard Rothman

      5 out of 5 stars Great Book!.......2007-02-16

Excellent reference on how to extract money from retirement plans. Gives specific requirements necessary to receive penalty free withdrawals. I highly recommend this easy to understand, plain english book.

      5 out of 5 stars Crucial Information.......2006-07-20

This book contains must have information for anyone owning an IRA. I had a previous version and wanted to keep current as I approach the magic age. This book tells you how to avoid fines and penalties from the dastardly IRS. Keep as much of your hard earned savings as possible for as long as possible by reading this book several times then saving it for future reference. I also marked many pages for my beneficiaries just in case. Do yourself a favor and invest in this book.

5 out of 5 stars Very User Friendly!.......2005-08-29

The book is well organized. I was able to use it, immediately, to answer 'basic questions' to help a relative avoid a costly mistake and, more importantly, to learn 'options' that could help. Though I am an insurance agent, I've had little exposure to the 401(k), IRA, etc., market. This book is quickly moving me to the 'top 20% group' of informed agents and financial advisors. I highly recommend it, thanks to Ed Slott!

5 out of 5 stars Pay attention to the sub-title.......2005-05-06

The reviewer plugging the "MarketBuster" book has totally missed the point of this NOLO book, which is given in the subtitle: Taking Your Money Out. The reviewer is talking about strategies for growing your account.

When you're in the savings/growing mode you're in a whole different situation than you're in when you're having to withdraw and/or live off your account. Going from one to the other requires a major change in strategy and, more important, a MAJOR change in mindset and, often, life style.

You're confronted with a whole new set of regulations, whether the reason for the change is retirement, inheriting an account, etc. The biggest change in mindset is that instead of the pleasant pre-retirement situation of watching the money accumulate, you have to recognize that you're now going to be watching it DECLINE. And unless you've got a tremendously more than sufficient account, you're going to have to live with the knowledge that you could outlive the account, possibly due to your own mistakes, some of which this book can help you avoid.

Four years ago I was confronted with making this shift a whole lot sooner than I'd planned, and with getting control of my retirement accounts under conditions where I had little help. Without the previous edition of this NOLO book, I would have been totally lost and probably made serious mistakes.

Now, one caveat: This book does not tell you how to MANAGE your withdrawals and account so as to produce INCOME; as one should expect from NOLO press as a LEGAL advice publishing house, it deals with the nuts, bolts, traps and hazards of the PROCESS of getting the money out.

In my situation I also found that there is not a whole lot of good material out there on the subject of managing your money and account IN the WITHDRAWAL stage, and this subject is affecting more and more people, as the country shifts from defined benefit (pensions) plans to plans like 401Ks and IRAs that place the job of investing and managing on the individual.

It is a whole lot more complex, risky, and stressful than most people realize, especially considering the general abysmal education (lack of) even young people receive on the subject, let alone people my age who were raised to count on pensions, etc. (And thank goodness for Social Security, which while far from adequate, can still supply a firm base of about 30 to 50% of a retirement income; although that's another issue)

So I recommend this book as essential for the basic procedures, but you will also need additional information on how to manage your income account(s). Personally, in addition to a good fee based financial planner, I found invaluable help from folks who have actually been doing the job for years, especially in the forums of Morningstar, for example. But you have to be on constant alert for scamsters and the whole "how to be a billionaire" publishing crowd. You're going to have to invest some serious time and effort in educating yourself for a the whole new job of retirement, and this book is an excellent place to start, preferably BEFORE you actually have to start TAKING YOUR MONEY OUT.

      5 out of 5 stars A practical, easy-to-understand instructional.......2004-10-12

Now in an updated and expanded sixth edition, IRAs, 401(k)s & Other Retirement Plans is a solid guide written especially for lay readers to better understand the types of retirment plans available in America. From tax issues, including taxes on early distributions, to the time at which one is required to take some distributions, to determining one's designated beneficiary in case of premature death, and much more, IRAs, 401(k)s & Other Retirement Plans is a practical, easy-to-understand instructional. Highly recommended for anyone cultivating an IRA or concerned about ensuring that the right person benefits from it.

The completely revised and updated fifth edition of The 100 Best Stocks to Own in America offers financial analyst Gene Walden's choices for the stocks best poised for long-term growth. It is especially appropriate for small- and first-time investors. Each entry--including 24 new to this edition--is rated on 5-year earnings-per-share growth, 10-year stock growth, 3-year dividend yield, 5-year dividend growth, consistency of year-to-year earnings gains over a 10-year period, and shareholder perks. Brief profiles of each company include a fiscal snapshot and contact information.

        Book Description

Savvy investors realize that blue chip investments are companies that are better capitalized and positioned to succeed in the changing marketplace where "bricks and clicks" alike are required. Among the best of the best, companies chosen by Walden for the previous edition have led the market indicators: the average return of his top five picks was 30.4% compared to -7.2% for the Dow Jones Industrial Average over the same one-year period.

The 100 Best Stocks to Own in America goes far beyond impressive figures for one year. Since its first edition in 1989, Walden's guide to stocks poised for superior long-term growth has not let investors down. In fact, hundreds of thousands of investors have used this information to create powerful portfolios. Many buy each edition of the book to see how the lists of companies have changed over time. What hasn't changed are the rigorous criteria for inclusion: only the strongest companies make the grade. Companies are selected on the basis of: earnings growth, stock growth, dividend growth, dividend yield, consistency, shareholder perks.

Walden shares inside stories and insights about investing along with contact information, details about the company, and explanation of the results. Results are illustrated for each company in a table of points, at-a-glance results, and a bar chart of stock growth. Listings by industry and state make this book an easy-to-use reference.

This book is an easy and informative read for selecting blue chip stocks. I still have the first edition and it is interesting to see how many stocks are gone from the original 100. My only problem with his book is the rating system. I do not believe that shareholder perks should have the same weight as stock growth and earnings growth.

5 out of 5 stars It is a good book for the starting investor.......1998-12-21

I used the book in selecting my initial portfolio.......the book provides a concise and consistent summary of the best performing stocks over the last 5 years or so.

5 out of 5 stars Excellent book for Blue Chips.......1998-10-10

Now in its 5th Edition this book is fabulous! It is a must read for anyone interested in building a solid portfolio of quality blue chip stocks.

Mr. Bauer describes a very interesting view of the political and business environment in Latin America, during the chaotic years of the 70's and 80's. His experience with the bribery schemes and military officials turned into wanna-be executives was very typical of the region. The stories are sometimes hillarious. I was born and raised in Brazil, and I saw a lot of this happening all around me. It is still normal and acceptable to depend on connections in order to obtain (unfair) competitive advantage. That explains a lot about the struggles of LA in the last 20 years. Overall, it is a very good reading, but I was disappointed with the grammar errors in Portuguese and Spanish. A quick revision would do it. I recommend it to anyone interested on a quick lesson about LA history and the commercial airplane business.
