The collapse of Britain's powerful labor movement in the last quarter century has been one of the most significant and astonishing stories in recent political history. How were the governments of Margaret Thatcher and her successors able to tame the unions?
In analyzing how an entirely new industrial relations system was constructed after 1979, Howell offers a revisionist history of British trade unionism in the twentieth century. Most scholars regard Britain's industrial relations institutions as the product of a largely laissez faire system of labor relations, punctuated by occasional government interference. Howell, on the other hand, argues that the British state was the prime architect of three distinct systems of industrial relations established in the course of the twentieth century. The book contends that governments used a combination of administrative and judicial action, legislation, and a narrative of crisis to construct new forms of labor relations.
Understanding the demise of the unions requires a reinterpretation of how these earlier systems were constructed, and the role of the British government in that process. Meticulously researched, Trade Unions and the State not only sheds new light on one of Thatcher's most significant achievements but also tells us a great deal about the role of the state in industrial relations.

The so-called culture industries--film, television and radio broadcasting, periodical and book publishing, video and sound recording--are noteworthy exceptions to the rhetorical commitment of Western countries to free trade as a major goal. These exceptions threatened to derail such high-profile negotiations as NAFTA and its predecessor, the Canada-US Free Trade Agreement, as well as the Uruguay Round of the GATT.Conventional wisdom did not foresee trouble from this source, because these established industries are not commercial national champions, nor are they particularly large providers of jobs. As Patricia M. Goff shows, the standard trade literature considers the monetary value but doesn't recognize the symbolic importance of cultural production. In Limits to Liberalization, she traces the interplay between the commercial and the cultural.
Governments that want to expand free trade may simultaneously resist liberalization in the culture industries (and elsewhere, including agriculture and health care). Goff traces the rationale for "cultural protectionism" in the trade policies of Canada, France, and the European Union. The result is a larger understanding of the forces that shape international trade agreements and a book that speaks to current theoretical concerns about national identity as it plays out in politics and international relations.

The authority of Polish communists in 1944-1945 was usurpatory; it was not given to them by the Polish people. Nor was the power they held the result of their own actions; they were installed as the country's rulers by the Soviet army. Yet Polish Communists set out to produce credible claims to authority and legitimacy for their power by reshaping the nation's culture and traditions. Jan Kubik begins his study by demonstrating how the strategy for remodeling the national culture was implemented through extensive use of public ceremonies and displays of symbols by the Gierek regime (1970-1980). He then reconstructs the emergence of the Catholic Church and the organized opposition as viable counter-hegemonic subcultures. Their growing strength opened the way for counter-hegemonic politics, the delegitimization of the regime, the rise of Solidarity, and the collapse of communism. He is not studying politics per se, but rather culture and the subtle and indirect ways power is realized within it, often outside of traditionally defined politics. Kubik's approach, which draws heavily on modern anthropological theory, helps explain why Solidarity happened in Poland and not elsewhere in the Communist bloc.

The starting point of this book is the coexistence of the overlapping regimes of the WTO, the EU and the NAFTA. On this basis it explores the emergence of a nascent Common Law of International Trade. This exploration is rooted in three phenomena: Firstly, the fact that the very same regulatory measure may come simultaneously within the jurisdictional reach of more than one trade regime and may even be adjudicated simultaneously. Some regimes offer alternatives. The NAFTA, for example, offers GATT dispute resolution as an option for many of its own disputes. Secondly, convergence in the material law of the disparate international trade regimes. This, of course, is the heart of the emergent Common Law. Thirdly, the strengthening of private parties in all regimes. Once a preserve of the EU, the NAFTA allows private party dispute resolution of different types in relation to various matters and in the case of the WTO, although it is still an intergovernmental preserve, private actors are learning to manipulate the system. This volume, built on a recent series of courses at the Academy of European Law, is a reflection of this conviction. The various contributions deal with discrete areas - in the double sense - of the international trading system but each placing considerable emphasis on the interlocking nature of the various components of that system. It is our conviction that this is the appropriate way to understand and to teach this branch of the law.
