International Competition Law: A New Dimension for the WTO?
Martyn D. Taylor Manufacturer: Cambridge University Press ProductGroup: Book Binding: Hardcover ASIN: 0521863899 |
Book Description
Should an international competition agreement be incorporated into the World Trade Organization? Taylor examines this question, arguing that such an agreement would be beneficial. Existing initiatives towards the regulation of cross-border, anti-competitive conduct have clear limitations that could be overcome by an agreement, and the WTO would provide the optimal institutional vehicle for it. At a practical level, Taylor points out, an international competition agreement could address under-regulation and over-regulation in the trade-competition regulatory matrix, realising substantive benefits to international trade and competition. This book identifies the appropriate content and structure for a plurilateral competition agreement and proposes a draft negotiating text with accompanying commentary, and as such will be an invaluable tool for policy-makers, WTO negotiators, competition and trade lawyers, and international jurists.

Regional Trade Agreements and the WTO Legal System (International Economic Law Series)
Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Paperback Similar Items:
ASIN: 0199207003 |
Book Description
The proliferation of regional trade agreements, including both free trade agreements and customs unions, over the past decade has provoked many new legal issues in WTO law, public international law, and an emerging law of regional trade agreements. The various Parts of this book chart this development from a number of perspectives. Part 1 introduces the economic and political underpinnings of regional trade agreements, their constitutional functions, and their role as a locus for integrating trade and human rights. Part 2 examines the WTO rules governing regional trade agreements, focusing on a number of areas in which regional trade agreements prove problematic, such as trade remedies, regulatory standards and rules of origin. Part 3 investigates areas in which regional trade agreements go beyond WTO rules, in areas such as intellectual property, investment, competition, services, sustainable development and mutual recognition, while Part 4 is devoted to the dispute settlement mechanisms of regional trade agreements, and includes illuminating case studies. Part 5 explores the interrelationship between regional trade agreements and the WTO system from the perspective of public international law, involving questions with significance beyond the trade community.

Remedies and the WTO Agreement (International Economic Law)
Chi Carmody Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Hardcover ASIN: 0199268762 |
Book Description
This volume reviews and assesses the legal remedies available under the WTO Agreement. It examines these remedies in light of reparative and punitive theories of justice, and concludes that WTO remedies are distinct because they seek principally to achieve compliance with the WTO Agreement. They do so principally by identifying a violation and leaving it to the parties to negotiate a settlement. The aim is neither to correct the injury, nor to punish the wrongdoer; but to create a new legal situation in which the wrong is unlikely to recur. WTO remedies are therefore akin to the declarative relief traditionally granted in public international law and domestic public law. A the same time, they pose a challenge to a developing international legal system that is increasingly oriented towards corrective and punitive justice. This is the first comprehensive text offering a complete review of remedial law and practice under the WTO Agreement. It provides comparisons of WTO law and its remedies and results with public international law, European, and domestic public law. It is highly relevant to lawyers, academics, and government officials seeking an explanation of what WTO dispute settlement actually achieves.

The WTO Anti-Dumping Agreement: A Commentary (Oxford Commentaries on International Law: Oxford Commentaries on the Gatt/Wto Agreements)
Edwin Vermulst Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Hardcover Similar Items: ASIN: 0199277079 |
Book Description
The book provides an analytical overview of the World Trade Organisation's Anti-Dumping Agreement, as interpreted by WTO Panels and the Appellate Body. The Anti-Dumping Agreement is often perceived as being the most technical and controversial WTO agreement. While the basic concepts of dumping and resulting injury may appear deceptively simple, complex methodology related to the calculation of dumping and injury margins, as well as the very detailed procedural requirements that authorities need to comply with before taking anti-dumping action, make the Anti-Dumping Agreement difficult to apply and understand in practice. While the book of necessity goes into great detail about the intricacies of anti-dumping law and practice, it attempts to explain the various concepts in a relatively non-technical manner by means of simplified examples that are easy to grasp for experts and non-experts alike. The book also pays extensive attention to interpretations of the various provisions of the Anti-Dumping Agreement by WTO panels and the Appellate Body. There have been more WTO cases under the Anti-Dumping Agreement than under any other WTO Agreement, reflecting both the increased recourse to anti-dumping measures by WTO members all over the world and the complexity of abiding by the WTO rules. WTO Panels and the Appellate Body, called upon to review administrative determinations and aspects of national legislation, have done a remarkable job in interpreting the WTO rules. For WTO members, wishing to impose anti-dumping measures in a WTO-consistent manner, knowledge not only of the Agreement itself, but also of such interpretations, is therefore a must.

John H. Jackson Manufacturer: Cambridge University Press ProductGroup: Book Binding: Hardcover Similar Items:
ASIN: 0521860075 |
Book Description
The last decade of the twentieth century and the first decade of the twenty-first century have been one of the most challenging periods for the generally accepted assumptions of international law. This book grapples with these long-held assumptions (such as the consent basis of international law norms, equality of nations, restrictive or text-based treaty interpretations and applications, the monopoly of internal national power, and non-interference), and how they are being fundamentally altered by the forces of globalization. It also examines the challenges facing the WTO as a component of international economic law, and how that field is inextricably linked to general international law.Customer Reviews:

The Panther Chameleon: Color Variation, Natural History, Conservation, and Captive Management
Gary W. Ferguson Manufacturer: Krieger Publishing ProductGroup: Book Binding: Hardcover Similar Items:
ASIN: 1575241943 |
Book Description
This is one of the first monographs to present a comprehensive study of the natural history of a single high-profile lizard species, the popular Malagasy panther chameleon. It is the first attempt to come to grips with the complex, often confusing, color variation of the species and illustrates these variations with 69 beautiful color photographs. The authors have drawn from the scattered literature, their extensive experience, and experimental study in the field and laboratory to provide original information and conclusions. They emphasize both the known and the unknown, presenting clear avenues for future investigation. They make a case for the panther chameleon as a model organism with value for research, education, herpetoculture, and conservation. This work also reviews the history of keeping chameleons in captivity and provides up-to-date guidelines for captive management of the panther chameleon based on the authors' own multigeneration captive colony.Customer Reviews:
