Book Description

A thorough revision of a tried and true classic, the seventh edition of Judicial Process in America offers a comprehensive study of the American judicial system that integrates new scholarship and original research. Including analysis of the courts at all levels, the authors cover judges, lawyers, and litigants, as well as the powerful variables that influence judicial decision making, effectively linking the courts to public policy. In response to feedback from adopters, the authors have increased their coverage of state courts and further explore the impact of race, gender, and socio-economic factors on the judiciary. Discussion of the ideological impact of George W. Bush's judicial appointments, including two new Supreme Court justices, and inclusion of recent cases on end-of-life issues, property rights, and gay and lesbian rights bring the book fully up to date.

    Book Description

Authored by two leading scholars of the Supreme Court and its policy making, this study systematically presents and validates the use of the attitudinal model to explain and predict Supreme Court decision making. In the process, it critiques the two major alternative models of Supreme Court decision making and their major variants--the legal and rational choice. Using the U.S. Supreme Court Data Base, the justices' private papers, and other sources of information, the book analyzes the appointment process, certiorari, the decision on the merits, opinion assignments, and the formation of opinion coalitions.

      Book Description

In Crafting Law on the Supreme Court, Maltzman, Spriggs, and Wahlbeck use material gleaned from internal memos circulated among justices on the U.S. Supreme Court to systematically account for the building of majority opinions. The authors argue that at the heart of this process are justices whose decisions are constrained by the choices made by the other justices. The portrait of the Supreme Court that emerges stands in sharp contrast to the conventional portrait where justices act solely on the basis of the law or their personal policy preferences. This book provides a fascinating glimpse of how the Court crafts the law.

      Book Description

The Supreme Court may appear to be a less political body than Congress or the executive branch, but in fact it is a fundamentally political institution, deeply engaged in the struggles for power that shape American politics and society. David O'Brien shows students how the Supreme Court is a "storm center" of political controversy, where personality, politics, law, and justice come together to help determine the course of public policy.

This thoroughly updated Seventh Edition of Storm Center continues to chart historic steps taken by the Court, drawing on new material from the recently opened private papers of Justice Harry A. Blackmun, and including expanded coverage of the Rehnquist court and its impact on American life.

      Customer Reviews:

5 out of 5 stars Witty and informative.......2004-07-11

As an undergraduate student studying constitutional law, I found this book an excellent introduction into the court politics. O'Brien writes and organizes his book in a coherent way, allowing for the maximum material absorption coupled with intriguing facts and footnotes. "Storm Center" reveals the court as a human and error-prone institution evolving over time into a kind of super-legislation, becoming at the same time both more independent and intertwined in regard to the other two branches.

Overall, an enjoyable read for anyone willing to peak at the kitchen of law.

5 out of 5 stars Helpful insight into the court..........2000-12-04

This is an excellent examination into the history of the court and the politics that led to its current make-up. O'Brien does a good job making this an interesting and often riviting historical examination.

This has become a valuable tool in my personal and educational understanding of today's court. With the public eye close to the court these days (Presidential Election) the individual and personal examinations that O'Brien has provided on the court has helped me to make my own judgements and predictions as to possible decisions. An excellent purchase for the beginner or well seasoned court watcher.

4 out of 5 stars Get Acquainted with the Supreme Court.......2000-05-23

If you know only a bare minimum about the Supreme Court, or know a lot, this is an excellent book to supplement that knowledge. It is both an excellent narrative about some of the biggest battles between the Justices themselves and an informational text explaining the ins-and-outs of how a case actually comes to be decided by the Court. All in all, it is well worth reading.

            Book Description

The Choices Justices Make is a groundbreaking work that offers a strategic account of Supreme Court decision making. Justices realize that their ability to achieve their policy and other goals depends on the preferences of other actors, the choices they expect others to make, and the institutional context in which they act. All these factors hold sway over justices as they make their decisions, from which cases to accept, to how to interact with their colleagues, and what policies to adopt in their opinions.

Choices is a thought-provoking, yet nontechnical work that is an ideal supplement for judicial process and public law courses. In addition to offering a unique and sustained theoretical account, the authors tell a fascinating story of how the Court works. Data culled from the Court's public records and from the private papers of Justices Brennan, Douglas, Marshall, and Powell provide empirical evidence to support the central argument, while numerous examples from the justices' papers animate the work.

5 out of 5 stars Invaluable account of the Court's internal dynamics.......2005-10-30

The basic accepted truth of modern political scientists (though not always lawyers) is that judges decide cases based primarily upon their policy preferences. The most extreme scholars argue that judges' decisions are based solely on this concern and no other. In their wonderful study, Epstein and Knight contend that this attitudinal model is too simplistic; it ignores that basic fact that justices must gather 5 total votes to enact their policy. This fact, they argue, requires justices to engage in strategic interaction that accounts for the choices of others and the institutional context. Thus, they study three different ideas: that justices' actions are directed toward attaining some policy; justices' are strategic; and institutions structure justices' interactions. Epstein and Knight test their contention through examination of the papers of various Burger Court justices. Their findings tend to support the strategic view of judicial behavior. What is important to remember, is that this book is not meant to be the end of the discussion, but rather the beginning. The authors candidly admit that this is meant to open up new avenues of judicial behavior research. This is a central text of modern political scientists and should be read by any serious student of the Court.

              Book Description

Because the justices of the U.S. Supreme Court tell us what the Constitution means, they can create constitutional change. For quite some time, general readers who have been interested in understanding those changes have not had a concise volume that explores major decisions in which those changes occur. Traditional casebooks used in law schools typically pay scant attention to the historical and political context in which cases are decided, as well as the motives of litigants, the involvement of interest groups, and the justices' concerns with policy outcomes, even though all these factors are critical to understanding the Court's decisions. Other books do address these concerns, but they almost always focus on a single policy issue rather than on a broader range of constitutional conflicts that populate the Court's docket.

In order to make a wide range of decisions more accessible, Gregg Ivers and Kevin T. McGuire commissioned twenty-two outstanding scholars to write essays on a selected series of Supreme Court cases. Chosen for their contemporary relevance, most of the cases addressed in this informative reader are from the last half-century, extending right up through Bush v. Gore and the 2003 Michigan affirmative action cases.

In each of these roughly two dozen cases, the authors address a number of questions that provide readers with a deeper understanding of the Court and its policies: How did the conflict originate? What role did organized interests have in the case? What did the litigants, personally and professionally, have at stake? What was the practical result of the Court's decision? Did the Court respond to lobbying or public opinion? These detailed historical and personal accounts in this all-new collection of essays offer engaging and illuminating perspectives on law and politics.

                Book Description

Part of the worldwide biodiversity program DIVERSITAS, the Global Mountain Biodiversity Assessment (GMBA) assesses the biological richness of high-elevation biota. GMBA's focus includes the uppermost forest regions or their substitute rangeland vegetation, the treeline ecotone, and the alpine and nival belts. Providing more than description, the GMBA explains the causes of biological richness and how diversity changes over time. Because biodiversity changes often result from human land use, part of the GMBA agenda is the assessment of land use impacts. These assessments are critical in low-latitude regions, where land use pressure on upland biota is the greatest. The chapters of Land Use Change and Mountain Biodiversity derive from a peer-review process that followed presentations offered at two GMBA workshops, one in Tanzania and the other in Bolivia. More than 50 researchers actively participated in these events, discussing information from all major mountain regions, with a particular focus on the Andes and on African mountains.

From the author: Rural private lands in the Mountain West of the United States are undergoing a profound land-use conversion, from agriculture to low-density residential or exurban development, though little scientific study documents the ecological consequences of this change. Nongovernmental conservation organizations are working with ranchers to keep rangeland out of development and in ranching, ostensibly because these organizations believe that biodiversity is better protected on ranches than on exurban developments. We compared plant and wildlife communities across the principal rural land uses in the Mountain West: protection, livestock ranching, and exurban development. Native plant and faunal biodiversity was better maintained on ranches and protected areas than on exurban developments. Exurban developments favored species that were nonnative or adapted to human-altered environments. The continued conversion of ranches to exurban development suggests a long-term alteration of the region's natural heritage. Keywords: biodiversity, exurban development, land use, ranching.
