Book Description

This volume will be of interest and value to students of logic, ethics, and political philosophy, as well as to members of the legal profession and to everyone concerned with problems of government and jurisprudence. By citing a large number of cases, the author makes his presentation of the processes of judicial interpretation particularly lucid.

3 out of 5 stars Not Quite an Introduction.......2007-06-16

While Levi clarifies much that's uncertain about legal interpretation, I don't recommend this book for those with no previous studies in law. If you must read it -- and there ARE rewards from doing so -- be sure to have a law dictionary at hand.

Besides using legal terms that aren't explained, Levi's prose is so dense as to be almost unreadable, but worse, it lacks anything resembling clarity. He often barges straight in to lengthy analyses of concepts without explaining the basic terms he uses or even why they're relevant; these must be induced from the text while reading. Since Levi is usually demonstrating through examples how concepts change over time, however, it's difficult to pin down what the concept means at any one point, before Levi has already jumped ahead to the next point without explaining either.

It's also highly recommended that you look up the cases Levi cites, since his quotations from judges rarely contain enough critical information to piece together the actual concept involved. Finding the original and just reading the parts that he replaced with ellipses add an infinite degree of clarity.

4 out of 5 stars Helpful.......2006-06-20

I found this book to be helpful but somewhat basic. I is outlined nicely and is easy to follow. Good future reference. Recommend to students.

5 out of 5 stars A Great Read.......2006-01-07

I appreciate Edward Levi's attention to detail. This book definitely goes beyond the standard textbook in terms of putting together a guide that is both interesting to read and informative. I'd recommend it to anybody in my situation, planning to attend law school, or even to practicing attorneys in need of a handy, compact reference guide to the basics.

5 out of 5 stars Law of the land.......2005-04-01

The power to determine the law of the land resides within every citizen of the country by means of electing the officials they choose and the judicial system only upholds the law. The citizens of a country elect their leaders and once elected they are enshrined with the right to uphold the economic and political stability but any improper actions of a government should be corrected by means of the judicial process rather than by any political process. All differing opinions should be allowed to coexist with checks and balances as determined by the judicial system.

5 out of 5 stars ambiguity made clear.......2002-08-17

Legal reasoning is famously ambiguous: there's no objective way to determine the outcome of a given case as there is with a physics problem. If you know the weight of an item and the height from which it drops, you are able to determine fairly objectively (i) the rate at which it will fall to the earth and (ii) the time it will take to fall to the earth from the point at which it is dropped. Law, unfortunately, is not so straight-forward. Understanding its assumptions is absolutely critical to developing any sort of sophisticated understanding about the ways in which law affects civilization. This book provides a broad outline of those assumptions. I suggest having at least a rudimentary background in intellectual history and political philosophy to get the most out of this book.

3 out of 5 stars Poor on evidence and reasoning.......2007-09-12

Not bad for an introductory text. However, short on the following: it does not present argumentation as a process. Or, at least it is not entirely clear on it. The process is lost in the details. Second, it has poor chapters on reasoning and evidence. It does not really explain what evidence is for. For example, the chapter on evidence (after a brief definition of evidence) begins with a statement that evidence can be found in the library etc. It completely misses the point of the importance of evidence. Later in the text it returns to some of the important points but treats them rather poorly.
The part on reasoning is very poor. Although a knowledgeable person could easily distinguish what is proper reasoning and what can serve as a rhetorical device, that may not be clear to a beginning college student.

5 out of 5 stars A Quality Product.......2006-03-20

This is a great intro to argumentation, and is useful to people of all ages and degrees of experience.

      Customer Reviews:

4 out of 5 stars The hitchiker's guide to legal reasoning. A must read........1999-02-12

I am currently a "1L" at a school in Washington DC.

Professor Vandevelde introduces the reader to a brave new world: legal reasoning. As a first year law student, you will become intimately aquatinted with such creatures as Contracts, Constitutional Law, Civil Procedure, and the peculiar little buggers known affectionately as Torts. But what you will need most on your adventure, you will find strangely absent: a map & compass. "Thinking Like a Lawyer," in my opinion, in simply that. Vandevelde's text effectively explains what legal reasoning entails, how it evolved into the beast that it is, and what makes it live and breathe. Further, T.L.A.L. is written in a very readable prose you will appreciate more and more once you've tasted a few clumsy judicial opinions. Most insightful and practical, in my opinion, are the final chapters, which illustrate the material by applying it to each of the first year's courses. I recommend this book, without reservation, to any now-or-future law student, and anyone curious about legal thought and application.

By the way, I met Mr. Vandevelde once, in 1997, at a law schools' forum held at the World Trade Center. A sincerely friendly man.

        Book Description

Robin Paul Malloy examines the way in which people experience the intersection of law, markets, and culture. He demonstrates the implications and the ambiguities of law in a market society through case examples, illustrative fact patterns, and problems based on hypothetical situations. His analysis provides a complete and accessible introduction to a vast array of economic terms, concepts, and ideas--making this book a valuable primer for anyone interested in understanding the use of market concepts in legal reasoning.

5 out of 5 stars Priceless tool for 1L's and other law students.......2004-03-29

During my first year of law school I asked my "legal research and writing" professor for an excellent and clearly written introduction to legal reasoning. He recommended Professor Burton's book.

This book will "demystify" all the bulls**t that first year professors want you to figure out for yourself. If all 1L's read this book, more law students will acquire a full skill-set during first year. Instead, the irrational legal educational system prefers to teach fear, insecurity, stress, and other unnecessary lessons that do not benefit law students, lawyers, or the public which we all aim to serve. Law professors shouldn't worry because they can still teach discipline, the art of inquiry, and HELP students LEARN.

Caveat: This book is not the Holy Grail. You still have to read all your cases and study for your exams. However, you will better understand "The Big Picture" and write an excellent exam if you take the time to understand what Professor Burton has clearly imparted in this book.

If you appreciate what I've said, feel free to ask me for more advice on how 1Ls and other law students can stop wasting time and reduce fear, insecurity, and stress.

4 out of 5 stars Excellent Introduction to legal theory and reasoning..........2001-06-21

in an easy-to-read short book. Burton has given the beginning student of law and layperson a very approachable introduction in plain language. A must for first-year law students or 1L's-to-be to put their learning into a context of legal theory. A good primer before moving onto reading Cardozo's The Nature of the Judicial Process and the Hart's The Concept of Law, both of which I'd recommend to 1L's interested in jurisprudence. Burton's primer is an introduction to how cases and rules relate in analogical and deductive legal reasoning; how legal reasons, conventions, policy, purposes, and not just rules alone, are used to help lawyers make predictions and judges make decisions. Finally, it concludes with a brief chapter on the legitimacy of our legal system. Core foundational ideas from which any law student begins to build his/her knowledge and understanding and then application of legal reasoning.

                  Book Description

The Irish way of life-- its music, food, beer, and literature-- has become a familiar export around the world in recent years.

But as this delightful book shows nothing can replace the experience of real Irish landscapes discovered. The stunning scenery, elegant town houses, and variety of country manors all contribute to an Irish identity which has survived centuries of foreign influence.

Drawing on over twenty-five years spent living in Ireland, the photographer Walter Pfeiffer has created a unique collection of images which illuminate the many moods of the island. From Donegal in the north to Wexford in the south, through Connemara and the Isles of Arran, the beauty of Ireland's countryside is revealed through views of Palladian villas, misty rhododendron-filled gardens, castles, and salmon rivers.

In the country manors and the town houses of Dublin the customs of fine Irish living show a love of elegance, good food, and music. Through a fascinating text Walter Pfeiffer describes the influence of the architecture and landscape on the Irish people and their way of life. Book Description

Eminent Marxist intellectual reveals class struggles in Nazi-torn Belgium.

"My story is a reaction against the travesty of history, with its wish to obliterate the crimes of some and the complexity of others…These then are the dead shadows, here are my ghosts risen from a past where I thought I had hidden them away forever."—from Born Jewish

This fierce memoir is both elegiac and indicting. Marcel Liebman's account of his childhood in Brussels under the Nazi occupation explores the emergence of his class-consciousness against a background of resistance and collaboration. He documents the internal class war that has long been hidden from history—how the Nazi persecution exploited class distinctions within the Jewish community, and how certain Jewish notables collaborated in a systematic program of denunciation and deportation against immigrant Jews who lacked the privileges of wealth and citizenship.

An eminent anti-Zionist and Marxist, Liebman tells the story of his family's struggle to survive in the face of persecution, terror and constant evasion, an existence observed with acuity, humor and lyricism.

4 out of 5 stars wonderful read except for last chapter (and intro by Jacqueline Rose).......2006-08-30

This is a spellbinding account of a Jewish teenager in Belgium, during the war. The second of four boys in a loving Jewish family in Brussels, Liebman gives density and texture to the anxieties, terrors, and perils of life under the Nazis. Always on the run, sometimes together, sometimes apart, Liebman is a superb observer of the venalities and kindnesses that accompany him through these tragic days. It is also a compelling coming of age story. All except the last chapter, which takes advantage of his survivor's status to mount a soap box against racism, with a special target being Zionism (hence Jacqueline Rose's breathless intro). Even aside from its polemics, the chapter feels like it is tacked on to what is otherwise a superb addition to Holocaust memoirs.

5 out of 5 stars A vivid memoir of one man's childhood tale of Nazi control, familial struggle, and the betrayal he faced from more powerful Jews.......2006-04-04

Born Jewish: A Childhood In Occupied Europe by graphically authored by Marcel Liebman and deftly translated by Liz Heron is a vivid memoir of one man's childhood tale of Nazi control, familial struggle, and the betrayal he faced from more powerful Jews in times already hard. As a revealing and historically important biographical account of international history during the second world war, Born Jewish is an invaluable documentation which is very highly recommended for historians and laymen alike, as each and all may take some interest and understanding in this book. Born Jewish is a compelling and valued addition to the growing library of Holocaust literature so fundamentally necessary if the world is never again to experience genocide on such a massive and methodical scale.

5 out of 5 stars A New Perspective on Nazi party and Holocaust.......2005-11-19

The holocaust is a "popular" topic. I don't mean that in the positive sense, but in the publishing sense. Much has been published on the holocaust, Nazi occupation and the party Hitler hosted. History demands that people write it and people demand to hear "the truth" about the past. "Born Jewish" offers something different, something that isn't necessarily in demand, but is neccessary for the canon of work on the war and aftermath of the holocaust.
Marcel Liebman, for anyone unfamiliar with his other work, is a reknowned Marxist/Leninist/Soviet Union historian and historical analysist. This is clearly, his most personal work, but he does not leave his politics or his academic work at the door. "Born Jewish", as he says, "questions history", not in the sense of the accuracy of the event(Liebman writes how dismayed he is that the world did not fully accept Hannah Arendt's accounts of Jewish collaboration with the Nazi's as having actually happened.) but in the sense of the accuracy of historical accounts of it.
The new perspective Liebman adds is one often obscured by accounts of Nazi occupation and anti-semitism: that class conflict did not dissolve the day the swastika was raised over Europe's cities. In fact, the Nazi's capitalized on the class difference amongst Jewish populations. For Liebman, the horror of his brother's execution at Auschwitz is intimantly connected with the horrors of exploitation and collaboration within the Jewish community.
Liebman composes his memories carefully and beautifully, resisting sacrilization of experiences he realizes must answer to history as much as to his own heart, and criticizing the radical Zionism that he was to see flourish during his lifetime.
The incredible forward by Jacqueline Rose is a great appetite whetter for the book. She sums up the book far better than I ever could: "Amongst other things, this memoir stands as an extraordinary rejoinder to those who insist that Israel is the only and definitive answer to the genocide of the Jews...It is one of the strenghts of [the memoir] that Liebman can be so unerring in this analysis while at the same time acknowledging the point where understanding trails off into uncomprehending terror, where the most painful part of mourning trumps all rational thought."
I highly reccommend this book for anyone who was interested in the slough of memoirs on the subject. It should be read alongside Judith Butler's new book on mourning, violence, 9/11, anti-semitism and the Israel-Palestinian conflict, "Precarious Life".

                        Book Description

Edward Heron-Allen was a polymath-one of the most remarkable of his era-many would simply say he was a genius. By profession a London solicitor, he was also a very distinguished zoologist (F.R.S.), historian, Persian scholar and translator, author of the classic book on violin making still in print and studied worldwide, cheirosopher and writer of early science-fiction novels. This extraordinary man had a large house in Selsey-where he reported upon the impact of the war, and also on a wide range of friends, acquaintances and organizations, nationally. His beautifully bound manuscript war diaries were recently discovered. They throw vivid light on the Home Front-London and Sussex-and on the Western Front, where the then over-aged polymath insisted upon serving.
